Terms of Service

Paying for a commission acknowledges that you have read and agreed to the following Terms of Service. If you have any questions about the terms, email me before payment.

GENERAL

1. If you are interested in a commission, please contact me via email at [email protected] with the subject line ‘Commission’.
In the email please include:

2. All Commissions will be signed and dated (no exceptions).

3. I reserve the right to use the final commission and process work leading up to the final commission in my portfolio, social media sites (i.e. Twitter, Tumblr, Instagram, etc), websites, galleries, books, etc.

4. I will assume that when payment is sent that I have all reference images required. Character sheets for references are preferred, of course, but I understand not everyone has them. Images done by other artists, text descriptions and animal/object/clothing references from Google are fine with me. If these are not given, I will have to guess. If something is necessary, tell me. I am not responsible for changing things on a commission later due to the client's oversight on a detail.

If your refs have a discrepancy, please let me know which is the MOST correct! Please do not send me a 12 paragraph RP description: simplify it down to the bare bones. Please attach rather than link references if possible, as websites are not always reliable! If you link a reference and I cannot access it, I will put off working on your art until I can access it.

PAYMENT

1. All payment are in USD via paypal, unless stated otherwise if you live in Chile, in which case it will be in CLP via CuentaRut.

2. All payment should be made through invoice method. I will invoice you. DO NOT send me any payment, it will be refunded.

3. At least a partial payment is required within three days of your commission request being accepted. Failure to do so will result in your request being dropped. If you need more time, let me know.

4. Once our negotiation is done and I start your commission, I cannot refund you the full amount. This is negotiable depending on the state of the commission.

5. Once the work is completed I cannot refund it.

ARTIST

By commissioning me, you’re purchasing my artist labour only. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.

1. I reserve the right to use any image I create as I see fit. I retain all rights to the image. This includes, but is not limited to, producing and selling prints or portfolios (print, digital or CD) and/or posting to my online galleries. I retain full commercial and distribution rights on any image I produce.

2. I will respect your request to not publicly post your commission if this has been talked beforehand.

3. I reserve the right to modify and resell any rejected sketches as "pre-posed" at a later date.

COMMISSIONER

The commissioner may upload the work done for them to their SNS as long as it is credited and linked back to any of my galleries (Twitter @ZamiArts, Tumblr @zamiart, Instagram @ZamiArts, Facebook @ZamiArts). Once a piece is commissioned, you may use it for any personal use that you please, including but not limited to icons, signatures, layouts, wallpapers, themes and personal site display.

1. You may not claim the work to be your own, edit or set it up for redistribution. You may not use it for any external projects, commercial or non-commercial unless agreed upon.

2. You may resell it for the price you purchased it with. As long as it's not for reproduction such as prints, t-shirts, mugs, charms, etc.

3. Commissions are intended for NON-COMMERCIAL use only.
If you are not sure whether your request counts as personal, feel free to ask me about its intended use.

ART FORMAT

The commissioner is paying for "digital art", therefore, they will not receive any physical item in the mail from this purchase. The commissioner will only receive a digital copy of the artwork that is custom-made to their order.
When the commissioner pays this invoice, they acknowledge that they understand and agree to this terms of service.

PROCEDURE

You understand that the artist is not working with only your priorities in mind. They will take steps that are time consuming and slow, taking to 2 days to 3 weeks depending on the complexity of your request.

1. After payment is received: I sketch, colour and paint depending on your commission type.

2. I do not accept "description only" commissions. You must have at least one visual reference.

3. Sketch commissions do not have an approval stage. You may request minor tweaks if I missed any distinguishing features present in your reference.

4. For larger, full colour commissions, one large edit is allowed during the sketch phase. I reserve the right to add a $10 USD fee over any important edits after the first one.

5. Please be clear and concise in your description of the change. You can use other works and photos you like as references for the changes!

6. I will always distribute a "color test" to fix any color errors of your character! Please, let me know if I have made any mistakes. Anything that needs to be fixed on my mistake, as it was on your reference(s) and I missed it, will always be fixed for free.

7. A full size, no watermark image will be given. It is necessary that you use a watermark/resized version of the image before sharing publicly.
